Please read these Conditions carefully before using this Website. These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you signify your agreement to be bound by the terms and conditions set out below and any other conditions or notices set out on this website. If at any time you do not wish to accept these terms and conditions, you may not use or access this Website.

We recommend you print a copy of these Conditions for future reference. We amend these Conditions from time to time as set out in clause 24. Whilst we will endeavor to inform you when modifications arise we are not obliged to do so. Please check these Conditions every time you wish to order products from our site.

  • Account registration
    • When you register an account with Technovetmalta to use the website you agree the information and personal details you provide on registration and at any time are correct and complete to the best of your knowledge. You agree to keep your account information and personal details up to date and inform us immediately of any changes to the information. You can access and update your details online in the ‘My Account’ area of the website or by contacting our Customer Care Representatives by email or by telephone.
    • You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
    • You may not sign up for more than one account with Technovetmalta per person. For this purpose we reserve the right to cross-reference the names and addresses of new members with our existing customer database.
    • When you register an account with Technovetmalta to use the website you must create a password. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. We shall not be liable to you or any other person, company or any other entity for any loss or damage, which may arise as a result of any failure by you to protect your password or account.
  • Your Account
    • You agree to accept responsibility for all activities that occur under your account or password.
    • You should take all necessary steps to ensure that the password is kept confidential and secure and you should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.
    • We reserve the right to refuse service, access to the Website, terminate accounts, cancel orders or remove or edit content at our discretion if you are in breach of applicable laws, these Conditions or any other applicable Conditions or Policies.
    • We reserve the right to close your account or to cancel any order where we suspect at our sole discretion that you have opened multiple accounts to assist prescription fraud or to take advantage of discount codes limited to one use per person.

  • Access
    • You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.
    • We will do our utmost to ensure that availability of the Website will be uninterrupted and that transmissions will be error-free; however, due to the nature of the Internet, this cannot be guaranteed. Your access to the Website may occasionally be suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

    • Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. However, please be assured that we verify prices as part of our dispatch procedure. If a product’s correct price is lower than our stated price, we charge the lower amount and send you the product. If a product’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before dispatch or cancel your order and notify you of such cancellation.

  • Our Contract
    • Our Contract will be on these terms and conditions to the exclusion of all other terms and conditions (including any which you purport to apply under any purchase order, confirmation email, specification or other document or transmission).
    • Technovetmalta will endeavour to ensure that the supply of products through our Website complies with the relevant laws on veterinary medicines, as amended from time to time.
    • When you place an order to purchase a product from Technovetmalta, we will send you an email acknowledging your order and containing the details of your order. However, please note this does not mean that your order has been accepted.
    • Your order represents an offer to us to purchase a product, which is accepted by us when we send an email confirmation to you that we have dispatched that product to you (the “Order Dispatch Confirmation” Email). That acceptance will be complete and the contract between us will only be formed at the time we send the Order Dispatch Confirmation Email to you. Any products on the same order which we have not confirmed in an Order Dispatch Confirmation Email to have been dispatched do not form part of that contract. If we are unable to supply you with a product, for example because that product is no longer in stock or no longer available because of an error on our site (including without limitation an error regarding the price or the nature of the product you ordered) we will inform you by email and will not process your order. If you have already paid for the products, we will refund you the full amount as soon as possible.
    • We reserve the right to decline the acceptance of any order or cancel an order, in full or in part, at any time where we reasonably suspect that you have not acted wholly in accordance with these terms and conditions.
  • Ordering Products
    • You agree to pay us the full amount and you understand the requirements for ordering Prescription Drugs.
    • All images are shown for illustration purposes and packaging may vary due to changes made by manufacturers and/or our suppliers.
    • To check the availability of a product please send us an email to info@technovetmalta.com or call one of our Customer Care representatives.
    • You are able to change the content of your order at any time before payment is made by following the steps on the website. If you want to change your order after this time or you have any concerns regarding your order, we recommend you call our Customer Care line on xxxxxxxx. We do not recommend emailing us to change your order contents or delivery address as we may not see this in time. If you do send an email with corrections, which we fail to see in time, we are not responsible. Orders cannot be changed after dispatch.
    • We recommend you always place your order in time to allow for an unexpected delayed delivery. This even applies when using our Courier service as this can never be absolutely guaranteed. We will do our reasonable best to get your items to you on time, but if you have not allowed for any unexpected delay and you incur additional costs or inconvenience due to the delayed receipt of order, we will not be responsible for this.

  • Prescription Medication
    • Where an order is placed for a prescription only medicine you will need to obtain a signed prescription from your veterinarian. This must be sent to us within 28 days of your order using one of the methods set out on our ‘Prescription Information’ page. Failure to send the prescription within 28 days of ordering may result in cancellation of your order unless otherwise agreed with Technovetmalta. You will receive a credit for any sum that has been paid by you for the product less reasonable expenses incurred by Technovetmalta in processing your order. Please note that Technovetmalta will not dispatch your prescription only medication until we receive a valid prescription signed by your veterinarian.
    • If you attempt to purchase more prescription medication than is allowed on your prescription, we will reduce your order to the amount allowed and credit your account appropriately.
  • Altered Prescriptions
    • You are advised that the Veterinary Medicines Regulations (“VMR”) were amended in 2009 to make it a criminal offence to tamper with a written prescription. Schedule 3 Part 5(3) of the VMR states that ‘no person may alter a written prescription unless authorised to do so by the person who signed it’. Technovetmalta has a zero tolerance policy for altered or forged prescriptions. We check all prescriptions received to verify their authenticity. Where we suspect the prescription has been illegally amended, altered or tampered with we will immediately notify you and contact the relevant veterinary practice. If our suspicions are confirmed by the relevant practice we shall immediately cancel the whole of the order in which the altered prescription is included, de-activate the relevant user account and report the misuse to the Veterinary Medicines Directorate. If we suspect the authenticity of a prescription and that it has been created fraudulently using a veterinary surgeon’s identity, in addition to the above measures, we shall report the matter to the police who will deal with it as a matter of fraud.
    • In all cases where we suspect a prescription has been illegally altered or is a forged document we shall charge a Reporting Fee of £50 per prescription. By agreeing to these Terms and Conditions you agree that we may deduct the Reporting Fee from the payment received with the order and return the balance to you. If the payment received with your order is less than the Reporting Fee, you agree to provide us with the balancing payment within 7 days of notification.
  • Your responsibilities
    • In order for us to ascertain the suitability of sending veterinary products to you, we will require you to supply key information (such as species, breed, age and weight) on the animal concerned. It is vital that all information you supply to us is complete and accurate in all respects because we will, in good faith, rely entirely on the key information you provided in order to ensure that we provide the correct and appropriate (if at all) medication to your animal. Any false or inaccurate information you supply to us could result in certain products being prescribed to your animal that are unsuitable or inappropriate for the intended use you have specified to us. Therefore, you hereby undertake at all times to provide true, complete and accurate information to us when ordering any veterinary products from us. You hereby acknowledge that we shall have no liability or responsibility for any direct or indirect loss or damage that may result to you, your animal or a third party incurred as a result of our reliance on false or inaccurate information supplied by you or on your behalf.
    • Prior to the purchase of products, it is important that you are satisfied regarding the following matters: the appropriateness of particular products, correct use, storage, handling, waste disposal and correct administration of products. In order for you to be satisfied regarding the matters set out above in respect of veterinary medicinal products, we ask that you read the data sheet(s) that apply to the veterinary medicinal products that you intend to purchase, which you can find in the Product Information Database of Veterinary Medicines Directory’s website (VMD) (a link to which will be available on the product page), prior to confirming and proceeding with purchase of veterinary medicinal products. Please note that we will use reasonable endeavours to ensure that every veterinary medicinal product supplied by us will be accompanied by an applicable datasheet.
    • If you wish to obtain advice or have any queries regarding any of the products supplied by us on this Website prior to the purchase of those products including without limitation, if having read the relevant information in the applicable data sheet(s), you still have a query or wish to obtain further advice regarding any veterinary medicinal products, we strongly encourage you to contact our vet or SQP by using the contact details set out in the ‘Contact Us’ section of the Website.
    • Resale of any medicine products purchased on our Website is strictly prohibited.
  • Non-Prescription Medication
    • When purchasing non-prescription items from the website you may be asked to provide some additional information about your animals’ health so we can ensure that the non-prescription item is suitable for your animals’ needs.
    • You agree by accepting these Conditions to read and check the manufacturer’s datasheet supplied, to use the product according to the manufacturer’s guidelines and to check that the products are suitable for the species, age, and weight of animal and correct indication. If you are in any doubts as to the suitability of the items, you must contact us on our Customer Care line on xxxxxxx or contact your own vet.
  • Price and Product Availability
    • Price shown will be inclusive of VAT but exclusive of delivery costs.
    • Payment for the products is due immediately upon placement of your order. Despite our efforts, a small number of the products listed on our Website may be mispriced. Rest assured, however, that we verify prices as part of our dispatch procedure. If a product’s correct price is lower than our stated price, we charge the lower amount and send you the product. If a product’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before dispatch or cancel your order and notify you of such cancellation.
    • Should you wish to place an order online, you will be required to complete an order form and pay by credit/debit card. Alternatively, you can order products by contacting Technovetmalta by telephone. By placing an order by telephone you are agreeing to be bound by these Conditions.
    • No payment shall be deemed to have been received and no delivery will take place until Technovetmalta receives cleared funds.
    • If an item is not available at the time of ordering, this will be mentioned as “out of stock” on the product information page. As we process your order, we will inform you by email if any products you order turn out to be unavailable.
    • Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such.
  • Product Quality
    • We are under a legal duty to supply goods to you that are in conformity with the contract between us.
    • All veterinary medicines on our Website are sourced from UK veterinary wholesalers and dispensed by qualified and registered UK veterinarians.
    • Technovetmalta will endeavour to deliver products that are not due to expire within a reasonable period of time of the date of delivery. However, please note that veterinary products are in their nature liable to deteriorate or expire rapidly. We therefore strongly recommend that you check the expiration date on the manufacturer packaging of the product delivered to you and make sure that it is used within the time frame.
    • It is your responsibility to store, use and maintain the products as outlined in the manufacturer datasheet/written instructions.
    • The images of the products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflects the colour of the products. Your products may vary slightly from those images.
  • Horse Passports
    • It is a legal requirement that all horses, ponies and donkeys must have a valid passport. It is your responsibility as the horse owner to endorse your passport (normally section IX) to confirm whether the horse is/is not intended for human consumption.
    • Certain medications are not permitted to be administered to a horse if it is intended for human consumption. We have highlighted these products on our Website but you agree it is your responsibility to check your horse has been signed as ‘not intended for human consumption’ in the passport.
  • Off licence medication
    • Under UK legislation, where there are no suitable drugs specifically authorised for the treatment of a particular species or a particular medical condition in that species, a medical product authorised for a different medical condition, or for use in another animal species or humans, or under certain circumstances a specially prepared unauthorised product, or a medicine imported from another Country under a Special Treatment Authorisation may be used for the treatment of your animal with your consent. Such products (termed “off licence” products) will be used only when your vet considers them to be the most appropriate treatment.
    • Where an order is placed for an off licence medication, you will need to obtain a signed prescription from your veterinarian and send a copy to us within 28 days of your order using any of the methods described on our ‘Prescription Information’ page on our Website. If email or upload methods are used initially, please be aware a hard copy of your prescription must also be sent within 28 days of your order.
  • Security
    • Technovetmalta accept payments made via credit or debit card using Paypal. When you purchase items from the Website, you agree that the credit or debit card you use to pay for purchases is your own.
    • Technovetmalta holds no information regarding your credit/debit/bank account details. You will receive a confirmation email that the transaction has been authorised and that your card has been debited. You will also receive a reference number with this confirmation, which will be required for any correspondence.
    • Technovetmalta are PCI (Payment Card Industry) Compliant, this means our processes and infrastructure are reviewed regularly to ensure we meet high operational standards. This is certified by Security Metrics, for full details of their service and the PCI standards please click here.
    • Technovetmalta has taken reasonable steps to ensure security of your personal information from loss, misuse and unauthorised access. However there are no guarantees. You should keep in mind that no Internet transmission is ever 100% secure or error-free. In particular, any email sent to or from this site may not be secure, and you should therefore take special care in deciding what information you send to us via email. Any information you do provide us with, regardless of method or purpose, is at your own risk.
  • Payment
    • Technovetmalta process payments by PayPal.
    • PayPal handles payments for over 230 million users worldwide. PayPal to international PCI (Payment Card Industry) and CISP (Cardholder Information Security Program) standards for data protection. It deploys address and card verification checks and runs under 128-bit encryption.
  • Deliveries
    • Upon receipt of your order for products not requiring a written prescription or receipt of your signed prescription for your prescription only medicines products, Technovetmalta will endeavour to deliver your products to you within 7 working days. Where Technovetmalta is unable to deliver your products within 30 days from the day of receipt of your order, or as applicable, signed prescription, Technovetmalta will advise you by email of the reason for the delay and provide a revised date for the delivery.
    • If for any reason you do not accept delivery of any of the products or Technovetmalta is unable to deliver the products on time because you have not provided the appropriate instructions, Technovetmalta may attempt to deliver the product again in which case you will be liable for all reasonable related costs and expenses.
    • The products will be under your risk and responsibility from completion of delivery. However, you will only own the products once we have received payment in full, including all applicable delivery charges.
    • Please note that some couriers, under your instruction, may leave the products with a neighbour, or in a place on your property which they consider to be a ‘safe place’ if you are not in. We cannot be held liable for any parcels that go missing when left as instructed.
    • For next day delivery, we must receive your order and prescription (if applicable) before 12 noon on the day of dispatch.
  • Returns and Refunds
    • We understand that on occasion you want to return an item you purchased from us. We are striving to make this process quick and convenient for you. For more information on returns or to request a return or refund, call us on xxxxxxxx or email info@technovetmalta.com.
    • Medicines
      • Unfortunately, due to regulatory law, we cannot accept the return of any medication including flea and worming treatments. If you return such a medication to us, we can dispose of this for you but are not authorised to resell this. However, if an order containing medicinal products is faulty, we will accept returns within 60 days of the order date
    • Other Products
      • If for any reason you are not satisfied with any product you purchased from us, you can return by notifying us within 14 calendar days of receipt. The product must be returned within 14 calendar days of your notification to us in its original packaging, unopened and in condition for resale. You can use the model instructions for cancellation found on our ‘Returns & Refunds’ page on our Website.
      • If you cancel your contract we will:
        • refund you the price you paid for the products. However, please note we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop;
        • refund any delivery costs you have paid, although, as permitted by law, the maximum refund will be the costs of delivery by the least expensive delivery method we offer. For example, if we offer standard delivery at one cost but you chose to have premium delivery at a higher cost, then we will only refund what you would have paid for the cheaper delivery option; and
        • make any refunds due to you as soon as possible and in any event within the deadlines indicated below:
          • if you have received the product and we have not offered to collect it from you: 14 days after the day on which we receive the product back from you or, if earlier, the day on which you provide us with evidence that you have sent the product back to us; or
          • if you have not received the product or have received it and we have offered to collect it from you: 14 days after you inform us of your decision to cancel the contract.
  • Amendments
    • We reserve the right to make changes to our Website, policies, and these Terms and Conditions at any time. You will be subject to the policies and Conditions in force at the time that you use the Website, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). We suggest that you check for changes regularly. You are responsible for reviewing the current version each time you visit the website. You may wish to consider printing a copy of these terms and conditions for retention.
  • Complaints

    • eVetDrug, its directors, shareholders and associated persons shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, your or your company’s personal information or material and information transmitted over our system. In particular, neither we nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.
  • Indemnification
    • You hereby agree to indemnify and hold us, and our officers, directors, employees, agents and suppliers fully indemnified for any losses, costs, actions, proceedings, claims, damages, expenses (including reasonable legal costs and expenses), or liabilities, whatsoever suffered or incurred directly by us as a consequence of your breach or non-observance of these Conditions or the contract, your improper use of this Website or in relation to any claim which may be brought against us by a third party in relation to your use of the Website.
  • Events beyond our reasonable control
    • We will not be held responsible, if any delay or failure to comply with our obligations under these Conditions arises from any cause that is beyond our reasonable control. This condition does not affect your statutory rights.
  • Waiver
    • If you breach these Conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Conditions.
  • Severability
    • If any of these Terms and Conditions is deemed to be invalid, void or unenforceable for any reason, that Condition shall be deemed severable and the remaining Terms and Conditions shall not be affected by such invalidity or unenforceability and shall remain in full force and effect.
    • All provisions of any of the Terms, Policies and Information Notices are, notwithstanding the manner in which they have been grouped together or linked grammatically, severable from each other. Please contact us if you require clarification on any of the terms in this statement.
  • Governing Law and Jurisdiction
    • This website is based in Malta. These Conditions shall be governed by and construed in accordance with the Maltese laws. Any disputes arising in connection with any purchases made from Technovet Ltd and any other use of this Website, will be subject to the exclusive jurisdiction of the Maltese Courts.
